CASE SUMMARY
1. On December 2, 2005, a proposed class action lawsuit was launched against Toshiba of Canada Limited and Toshiba Corporation by representative plaintiff Brian Lin of Vancouver, British Columbia. The plaintiff proposes to represent all persons in Canada who purchased the Toshiba Satellite A70 computer notebook (the "Notebook").
2. The lawsuit alleges that the Notebook contains an inherent static discharge defect which causes it to freeze, reboot and/or crash, shut down, lock-up with a black screen and/or damage hardware components in the Notebook.
3. On or about February 21, 2005, Toshiba posted a Support Bulletin on its website titled "Satellite A70 - Spontaneous system reboot, shutdown or lock-ups" stating, in part:
Description:
Your Satellite A70 may periodically reboot, shutdown or freeze.
Resolution:
If this occurs immediately after touching your computer, please have your notebook checked-out by any Toshiba Authorized Service Provider.
4. The lawsuit alleges that Toshiba negligently designed and manufacturered the Notebook and breached it's manufacturer's warranty.
